These Terms of Use (“TOU”) are published by POLICY GURU INSURANCE SERVICES PRIVATE LIMITED; a company incorporated under the Companies Act, 2013 with CIN.: U67100MH2021PTC373884, having its registered office at 3rd Floor, A-Wing, Vaman Techno Centre, Marol Makwana Road, Andheri East, Marol Naka, Mumbai, Mumbai, Maharashtra, India, 400059 –=, hereinafter referred to as “Policy Guru” / “Company” operating the web platform www.policyguru.in (“Website”). Policy Guru / Company operates its business through its brand “Carepal Secure”.
These TOU sets forth the terms and conditions of the User’s (as defined below) use of the Website and the Services (as defined below), through the Website and is in addition to (not in lieu of) any specific terms and conditions that apply to the particular Services (if any). Before you may use the Website, you must read and accept all of the terms and conditions in, and linked to, this Terms of Use and the linked Privacy Policy. Use of any functionality of the Website constitutes acceptance of this TOU. In the event of conflict of these TOU with any other documents, the TOU shall prevail for the purposes of usage of the Website. 1. DEFINITIONS
“Account Information” shall mean information required by user to open an account with Website as below:

“Policy Guru Account” shall mean the account created by the User by providing the Company with Account Information.

Policy Guru Website is a unique and an independent consumer awareness platform that provides information and analysis on various insurance plan/ products/ policies to help the Users appreciate the differences, advantages, shortcomings in the various insurance plans, products or policies as well as offers a place to ask questions and connect with people who contribute unique insights and quality answers through their own knowledge and experience; which shall help User make a choice of product as well as insurer. The Company may also offer independent third-party wellness or health-related products, containing features like online doctor consultations, health check-ups, medicine delivery etc (“Third Party Products”).
By accessing this Website, and furnishing your personal / contact details, you hereby agree that you are interested in availing and purchasing the Service(s) that you have selected. You hereby agree that Company may contact you either electronically or through phone, to understand your interest in the selected products and Service(s) and to fulfill your demand. You agree to receive promotional materials and/or special offers from Company through email or SMS.
Beta Services: The current version of the Website is likely to undergo changes as the Company is relentlessly working to improve and enhance the User experience. User agrees that at this stage the Company shall not be bound by any statements of a general nature, which may be posted on the Website or contained in the Company's promotional materials.
2. Authorized Use, Website Access and Licenses
Company grants you a personal, limited, non-exclusive license to use and access the Website and the Service. Users shall ensure that it shall not have more than one active account. Further, Users are prohibited from selling, trading, or otherwise transferring their accounts to another party. In consideration of your use of the Website, you represent that you are of legal age to form a binding contract and are not a person barred from receiving services under the laws of India or other applicable jurisdiction. For security purposes, as best practice, User should keep changing the password of their Policy Guru Account frequently or as and when prompted. In the event that the User forgets the password to their Policy Guru Account, the User can click on “Forgot Password” and follow the password reset instructions received on their registered email ID. Further, it is the duty of the User to safeguard User’s password from any unauthorized use.
5. User Content
Company does not claim ownership of User Content you make available through the Website. At Company's sole discretion, such materials may be included in the Service in whole or in part or in a modified form. With respect to such materials you submit or make available for inclusion on the Website, you grant Company a perpetual, irrevocable, non-terminable, worldwide, royalty-free and non-exclusive license to use, copy, distribute, publicly display, modify, create derivative works, and sublicense such materials or any part of such materials (as well as use the name that you submit in connection with such submitted content). The User shall be obligated to extend all assistance as may be required by the Company from the User in this regard.
g.User agrees to provide government-issued photo identification and/or government issued business identification as required for verification of identity as and when requested by the Company.

Solely to enable the Company to use the Account Information supplied to it by the User and to ensure that the Company is not in violation of any rights the User may have in the Account Information, the User agrees to grant the Company a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sub-licensable (through multiple tiers) right to exercise the copyright, publicity, database rights or any other rights the User has in the Account Information, in any media now known or not currently known. The Company will only use Account Information in accordance with these TOU and Privacy Policy applicable to direct the User to their Policy Guru Account.

Company offers unbiased, accurate and responsible data to the best of our ability; however, in no manner or form Company shall be responsible for any discrepancies in the data published on our Website. There is no intention or purpose of violating any intellectual property or ancillary rights. All information provided on the Website is subject to its discretion and is likely to change without any notice. Although we have tried to maintain high standards in quality, clarity and accuracy of the material posted on the portal, Company is not legally responsible for the same in any manner whatsoever. Employees, partners and associated staff of Company are not accountable for any loss, harm or damage that occurs or may occur or arise from the usage of information from the portal. Customers are advised to use their own discretion in such matters. It is important to understand that insurance is a subject matter of solicitation and market risks. It is the responsibility of the customer to understand the limitations of insurance policies and the risks involved, and under no circumstance, form or manner, do we take any liability in such cases. It is a mutual understanding between us and the customers that their association with the portal will be at the customer's sole discretion and risk.
The Company also disclaims any and all liability arising out of any loss, damage, or inconvenience caused due to errors, omissions, delays, interruptions, modifications, discontinuation or non-performance, quality, availability, performance, accuracy, fulfilment of timelines, business practices in relation to any of the Third-Party Products offered by the Company.

9. Revision of Services
The Company reserves the right to withdraw/suspend/cancel/discontinue any or all the services without prior notice and make modifications and alterations in any or all the content, and services contained on the site without prior notice and at the sole discretion of the Company.
10. Cancellation/Refund Policy
As per the IRDAI rules and regulations, you have the right to cancel your insurance policy within 15(fifteen) days from the date of receipt of the insurance policy (referred to as “Free look period”). This Free look facility can be availed only for Life and Health insurance policies, subject to certain other terms and conditions specified by IRDAI. We encourage all our customers to read the insurance policy document carefully and avail yourself of the free look facility in case the terms and conditions of the insurance policy document don’t match your insurance requirements. In case of a cancellation, the premium paid for an insurance product will be refunded via cheque or direct credit as per the policy of the Insurance provider that you have chosen to buy the product from; subject to deduction of (i) charges pertaining to medical tests conducted (ii) administrative and service cost like stamp duty etc. and (iii) charges for mortality for the period the policy was in force. Please note such deduction is at the sole discretion of the insurer.
You hereby acknowledge that the Insurer operates as an independent entity with its own responsibilities, obligations, and liabilities. Policy Guru shall not be responsible for, and hereby disclaims any liability arising out of, the Insurer's business practices, refunds, contractual agreements, or any other activities conducted independently of the services provided by the Company. The Company is only acting as a mere facilitator and aiding its customers for speedy refunds.
11. Chargebacks
You (cardholder) may dispute a transaction carried out through our website and file a chargeback with your issuing bank for the reversal of that transaction. Chargeback allows transactions to be reversed by you under specified circumstances such as, on account of (i) alleged forgery of the card number / bank account or other details (ii) any charge/debit made on a card that has been listed as a hot listed card or otherwise listed on the card association (Visa, MasterCard, etc.) warning bulletins (iii) duplicate processing of the transaction; or (iv) for other reasons as per applicable rules and guidelines issued by RBI, card Associations, your card/payment instrument issuing bank etc. However, we reserve the right to reject a Chargeback, including but not limited to, under the following circumstances:
Our Company shall not be liable to you, in any form or manner whatsoever, for any claims, disputes, proceedings which may arise in connection with Chargebacks initiated by you in the circumstances as specified under (a), (b) and (c) herein above.
12. Indemnity
You agree to indemnify and hold Company (and its officers, directors, agents, subsidiaries, joint ventures, and employees) harmless from any and against any claims, causes of action, demands, recoveries, losses, damages, fines, penalties or other costs or expenses of any kind or nature, including reasonable attorneys' fees, or arising out of or related to your breach of this ToU, your violation of any law or the rights of a third party, or your use of the Website.
13. Limitation of Liability
In no event shall the Company, nor its directors, employees, agents, partners, vendors, suppliers, or content providers, be liable under contract, tort, strict liability, negligence, or any other legal or equitable theory with respect to the service: i) for any lost profits, data loss, cost of procurement of substitute goods or services, or special, indirect, incidental, punitive, or consequential damages of any kind whatsoever, substitute goods or services (however arising) and ii) for any bugs, viruses, trojan horses, or the like (regardless of the source of origination).
The Company shall not be liable for any failure to perform its obligations hereunder where the failure results from any cause beyond the Company's reasonable control, including, without limitation, third party intervention, change in law or economic circumstances, mechanical, electronic, or communications failure or degradation.
IN NO EVENT WILL THE COMPANY’S / SITE’S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES OR CAUSES OF ACTION EXCEED THE AMOUNT YOU HAVE PAID IN THE LAST SIX (6) MONTHS, OR, IF GREATER, RS. 1000 (RUPEES ONE THOUSAND ONLY).
The limitations specified in this section will survive and apply even if any limited remedy specified in these terms is found to have failed of its essential purpose. If you use this Website from other locations, you are responsible for compliance with applicable local laws including but not limited to the export and import regulations of other countries. Unless otherwise explicitly stated, all marketing or promotional materials found on this Website are solely directed to individuals, companies or other entities located in India and comply with the laws prevailing for the time being in force in India. If any of these conditions are deemed invalid, void, or for any reason unenforceable, the parties agree that the court should endeavor to give effect to the parties’ intentions as reflected in the provision, and the unenforceable condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition. Headings are for reference purposes only and do not limit the scope or extent of such section. This ToU and the relationship between you and Company will be governed by the laws of the India without regard to its conflict of law provisions. You and Company agree to submit to the personal jurisdiction of the courts located in Mumbai jurisdiction with respect to any legal proceedings that may arise in connection with this ToU. The failure of Company to act with respect to a breach by you or others does not waive its right to act with respect to subsequent or similar breaches. Company does not guarantee it will take action against all breaches of this ToU. Except as otherwise expressly provided in this ToU, there shall be no third-party beneficiaries to this ToU.
